Terms of Use

1. Introduction and Scope

These Terms of Use ("Terms") govern your access to and use of FindHaus ("the Service", "we", "us", or "our"), an AI-assisted search and application drafting tool designed to help individuals find shared accommodation ("WG") listings in Germany.

By accessing or using the Service, you confirm that you are at least 18 years of age, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree to these Terms, you must not use the Service.

The Service is intended solely for personal, non-commercial use by individuals seeking accommodation for themselves. You may not use the Service for automated scraping, bulk resale of generated content, or any purpose that violates applicable law.

2. Description of the Service

FindHaus monitors publicly available rental listings on third-party platforms and uses artificial intelligence to generate personalised application messages based on your profile and search criteria. The Service is a convenience tool and does not guarantee:

the accuracy, availability, or quality of any third-party listing;

that generated messages will result in successful applications;

continuous, uninterrupted, or error-free operation of the Service;

that a landlord or listing provider will receive or respond to your application.

The Service is not affiliated with, endorsed by, or otherwise connected to any WG listing platform or third-party listing service.

Raw listing data retrieved from third-party platforms (such as listing URLs, prices, and descriptions) is held only for as long as needed to generate and deliver your matches and application drafts, and is automatically deleted from our servers after a maximum of 7 days. Records of messages you have already generated remain available in your dashboard history even after the underlying listing data has been removed.

3. User Accounts and Authentication

Access to the Service requires authentication via a supported third-party identity provider (currently Google). You are responsible for maintaining the security of your authentication credentials and for all activity that occurs through your account.

We reserve the right to suspend or terminate your account without prior notice if we determine, in our sole discretion, that you have violated these Terms or that your use of the Service poses a risk to other users or third parties.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. Prohibited activities include, but are not limited to:

impersonating another person or creating a misleading profile;

using the Service to send spam, fraudulent, or harassing messages;

attempting to reverse-engineer, decompile, or extract source code from the Service;

using automated means to access the Service beyond what it provides by design;

violating any applicable local, national, or international law or regulation.

5. Subscription Plans, Payments, and Cancellation

The Service is offered on a freemium basis. Free-tier users have access to a limited monthly message quota. Paid plans ("Basic" and "Pro") provide higher quotas and additional features as described on the pricing page.

All paid subscriptions are billed monthly in advance. Payment processing is handled by a third-party payment provider (Stripe). We do not store your payment card details.

Pursuant to §312g in conjunction with §356 of the German Civil Code (BGB), you have the right to withdraw from a subscription contract within 14 days of conclusion, provided that the provision of the digital service has not already commenced with your explicit consent and acknowledgement that your right of withdrawal is thereby forfeited. By activating your paid plan, you expressly consent to the immediate commencement of the service and acknowledge that your 14-day right of withdrawal is waived from that point.

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing cycle; no partial refunds are issued for the remainder of that period.

6. Intellectual Property

All software, design, brand elements, and content constituting the Service are the exclusive intellectual property of the operator or its licensors. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it as described herein.

Generated application messages are produced for your personal use. You may freely use, edit, and send them. We make no claim of ownership over content you generate through the Service.

7. Data Protection and Privacy (GDPR)

We process your personal data in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR") and applicable national data protection law. The data we collect includes your name, email address, profile text, search criteria, and generated application history, as described in our Privacy Information.

As a data subject under the GDPR, you have the right to: access your personal data; rectification or erasure of inaccurate or outdated data; restriction of processing; data portability; and to lodge a complaint with a supervisory authority. We do not sell your personal data to third parties. Data may be shared with infrastructure providers (cloud hosting, payment processing) strictly for operational purposes, under appropriate data processing agreements.

Where the Service is operated, supported, or hosted from outside the European Economic Area — including from India — we take steps to ensure an equivalent level of protection for your data, having regard both to the GDPR and to India's Digital Personal Data Protection Act, 2023 ("DPDP Act"). Any such transfer is made only on the basis of appropriate safeguards (such as standard contractual clauses) where required by applicable law.

We retain personal data only for as long as necessary to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. Raw third-party listing data is deleted on the rolling basis described in Section 2 above; account and billing records are retained for the periods required by applicable tax and commercial law.

8. Cookies and Technical Storage

The Service uses technically necessary browser storage (localStorage and session-scoped tokens) solely to maintain your authenticated session and enable the core functionality of the application. No third-party tracking cookies or advertising identifiers are set by the Service.

The third-party authentication provider (Google) may set its own cookies as part of the OAuth login flow. These cookies are governed by the provider's privacy policy, over which we have no control.

If we introduce optional analytics or tracking cookies in the future, we will update this policy and obtain your consent before doing so.

9. Disclaimer and Limitation of Liability

The Service is provided "as is" and "as available" without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

In no event shall the operator be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service, including but not limited to missed accommodation opportunities, losses arising from generated content, or reliance on third-party listing information.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under mandatory applicable law (including §§ 305 et seq. BGB regarding standard business terms).

10. Amendments to These Terms

We reserve the right to modify these Terms at any time. Changes will be notified via the email address associated with your account or prominently displayed within the Service at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the amended Terms.

If you do not accept the amended Terms, you must discontinue use and may request deletion of your account and associated data.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

For disputes with consumers domiciled in the European Union, mandatory consumer protection provisions of the consumer's country of residence shall apply to the extent they provide greater protection than German law.

The European Commission provides an Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution procedures before a consumer arbitration board.
